Terms and conditions for using Apifocal mobile applications.

By downloading, installing, or using any mobile application published by Apifocal LLC (collectively, the “Apps”), you agree to be bound by these Mobile Appplications Terms of Service (“Terms”). If you do not agree, do not download or use the Apps. These Terms constitute a legally binding agreement between you and Apifocal LLC (“Apifocal,” “we,” “us,” or “our”).
These Terms apply to all Apps published by Apifocal, including any Apps released in the future. Certain Apps may be subject to additional or app-specific terms presented to you within that App. In the event of a conflict, those app-specific terms will take precedence.
You must be at least 13 years of age to use our Apps (or 16 years of age if you are located in the European Union or European Economic Area, in accordance with GDPR).
Certain Apps may have a higher minimum age requirement, which will be reflected in that App’s age rating on the Apple App Store or Google Play Store. By downloading or using any of our Apps, you represent and warrant that you meet the applicable minimum age requirement for that App.
If we discover that a user does not meet the minimum age requirement for an App, we will terminate their account and access immediately.
Not all of our Apps require an account to use. Some Apps are fully accessible without registration, while others may require you to create an account to access certain or all features. Where an account is not required, these Terms still apply to your use of that App.

We reserve the right to suspend or terminate your account at our discretion, including for violation of these Terms.
Our Apps may offer digital goods, features, or subscriptions available for purchase (“Purchases”). By making a Purchase, you agree that:
For EU/EEA users: You may have a statutory right of withdrawal within 14 days of purchase. However, this right does not apply to digital content that has already been fully performed with your prior express consent.
You agree not to use our Apps to:
Our Apps and all of their content, features, and functionality — including but not limited to text, graphics, logos, and software — are owned by Apifocal (or our licensors/suppliers) and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use our Apps for your own lawful purposes.
You may not, without our express written permission:
Certain parts of our Apps may incorporate open source software components. Such components are licensed under their respective open source licenses, which take precedence over these Terms with respect to those components only. The use of open source components does not grant you any rights to our proprietary code, content, or other intellectual property. A list of open source components used in a particular App may be made available within that App or upon written request to ama@apifocal.com . Nothing in these Terms restricts your rights under, or grants you rights that supersede, any applicable open source license.
Your use of our Apps is also governed by our Privacy & Cookies Policy, which is incorporated into these Terms by reference. By using our Apps, you consent to the data practices described in our Privacy Policy. For users in the European Union or European Economic Area: We process your personal data in accordance with the General Data Protection Regulation (GDPR). You have the right to access, rectify, erase, restrict processing of, and port your personal data. You also have the right to object to processing and to withdraw consent at any time. To exercise these rights, contact us at ama@apifocal.com . You also have the right to lodge a complaint with your local supervisory authority.
THE APPS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APIFOCAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR OUR APPS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
For EU/EEA users: Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
We may suspend or terminate your access to any or all of our Apps at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the relevant App(s) will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page and, where required by law, notify you via email or an in-app notification. Your continued use of our Apps after changes are posted constitutes your acceptance of the revised Terms.
For EU/EEA users: Where changes are material, we will provide at least 30 days’ notice before they take effect.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or our Apps shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Delaware, USA, under the rules of the American Arbitration Association, on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.
For EU/EEA users: If you are a consumer residing in the EU/EEA, you may also be entitled to bring claims before the courts of your country of residence, and the above arbitration clause does not affect that right. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
